Ethical Concerns Raised by Collective Actions and Class Actions in the Court of Federal Claims

The court has seen a large number of multi-party actions brought under Rules 20 and 23 of the Rules of the Court of Federal Claims, claims typically arising under the Fair Labors Standard Act and the Fifth Amendment Takings Clause. This panel will explore the unique practice and procedure applicable to these cases and will discuss the ethical concerns triggered by such actions.
